FSRA Publishes Proposed Regulatory Framework for Transfer Schemes

The Financial Services Regulatory Authority (FSRA) of ADGM has published Consultation Paper No. 2 of 2026, which sets out proposed enhancements to the framework governing the transfer of business within ADGM. 

The proposals introduce a new, proportionate regime under Chapter 8A of GEN that retains Part 7 of FSMR for insurance business transfers, which will continue to require mandatory court sanctioning, and introducing less onerous regulatory notification/consent requirements for other business transfers. 

The new, streamlined regime seeks to preserve strong client protections for business transfers other than those of insurance business while ensuring that the proposed regulatory requirements remain efficient, targeted, and proportionate to the nature of the transfer.
